By accessing or using APEX AI Guardrails ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you are using the Service on behalf of a government agency or organization, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the Service.
APEX AI Guardrails is a browser-based AI Data Loss Prevention (DLP) and governance platform designed for local government agencies. The Service includes a browser extension, NIST AI RMF governance tools, policy generators, and related web-based tools provided by APEX AI Guardrails ("Company," "we," "us," or "our").
Access to the full Service requires a paid subscription. Upon subscribing, you will receive a Product Key tied to your agency. Product Keys are non-transferable and may not be shared outside your organization. Unauthorized distribution of Product Keys will result in immediate account termination without refund.
You agree to use the Service only for lawful purposes and in compliance with your agency's policies. You may not: (a) reverse engineer, decompile, or disassemble the Service; (b) use the Service to facilitate unauthorized data collection; (c) resell or sublicense access to the Service; (d) interfere with or disrupt the integrity or performance of the Service.
All prompt analysis and PII detection is performed locally in your browser. Sensitive content is never transmitted to our servers. Only anonymized metadata (event type, data category, timestamp) is logged for audit purposes. See our Privacy Policy for full details.
All content, software, and technology comprising the Service is the exclusive property of APEX AI Guardrails and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during your subscription term.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL DETECT ALL INSTANCES OF SENSITIVE DATA. THE SERVICE IS A TOOL TO ASSIST YOUR AGENCY — IT DOES NOT REPLACE YOUR AGENCY'S OWN DATA GOVERNANCE OBLIGATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX AI GOVERNANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or at our discretion with 30 days' written notice. Upon termination, your Product Key will be deactivated.
These Terms shall be governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Washington State.
We may update these Terms from time to time. We will notify subscribers via email of material changes. Continued use of the Service after notification constitutes acceptance of the updated Terms.
